We are going to tackle the area that makes our clients and prospective clients cringe, even more than doing their tax returns! 

We are going to talk about disability and death! Just the words can stop you from giving this area serious consideration. 

But blocking this area out of your mind and not facing your true “responsibility” and duty to provide for your surviving spouse, children, grandchildren or other family members will not make it go away. What it will do is cause unnecessary suffering and costs that could have been avoided!!!

 

Disability & Death

Secondly, last June, a sweeping new tax law was signed into Federal law that turned almost everything up side down on what you think you knew about taxes, estate planning, etc. This is on top of sweeping new IRA rules adopted this year by the IRS!

We have already diligently dissected the changes and drafted them into a revised edition of our FSI Legacy Will and Trust documents. By utilizing our estate planning document preparation services, you will get some of the the most modern, comprehensive legal documents in the east valley!

And, if you are a current FSI Legacy document client, you most likely know that if you don’t call us - we will eventually call you to offer an update as your estate planning document preparer, whenever the laws change. You went to the doctor and they told you that you have a funny looking mole on your arm. What do you do next? Hopefully you run tests and make sure you don’t have a form of skin cancer. If you do, wouldn’t you want it cut off or treated as soon as possible? Of course you would.

But what if we tell you that there is a very good chance that you WILL suffer a long term disability (6 months or more) before you die and remind you that there is a 100% chance that you WILL die someday?

As financial advisors, it is our job to tell you the risks. We are also going to take the liberty to tell you that you about the solution to the problems of disability and death. 

That doesn’t mean you have to do anything about it afterwards. No One Knows the  Road Ahead

But maybe we first need to convince you that it is procrastination that will cause most Americans to become disabled with no protective insurance coverage and that keep them from obtaining the proper legal documents - thus causing them to die in testate most of the time!  (Without a Will)

Almost as bad, most that have legal documents do not feel it is important to keep them up to date. I want to discuss some of the most recent changes in the law both here in Arizona and Nationally to try and convince you that NOW is the time to get this part of your financial planning done.

First, Arizona revised its’ statutes in May of 1998 regarding the Durable General Power of Attorney instrument. 

Truly, everyone with a checkbook should have this legal document. Though the revision states an older GPOA is still acceptable, WE SAY it is not since some financial institutions are rejecting older versions for our own clients. This document appoints an agent to take care of your money needs when you are not able to do so.
