Proper estate planning legal documents are required to accomplish most clients' goals in estate planning.  They have to be properly drafted, they have to be properly signed and executed, and they have to be properly updated when the laws change.  And you can always count on the laws changing! Therefore, you must also be prepared to keep your documents up to date when necessary, or their effectiveness may be greatly hindered in the future.

What about fees?  Click on the document portfolio that best describes your situation and you will find a price grid that explains what is included in the portfolio and the actual cost.  Be sure to look for the "on-line" discount for service orders that are prepared while in our site!

For ARIZONA residents only, we currently offer two types of popular Portfolio documents:

The Legacy Trust Portfolio ©

The Legacy Will Portfolio ©

This is a Revocable Living Trust Portfolio* for unmarried or married and separate asset clients, or for married clients who want to utilize  both lifetime Unified Credit exemption equivalents.  It is either an A/B Convertible Revocable Living Trust Portfolio or an A/B/C Convertible Revocable Living Trust.  If properly funded**, this portfolio may provide the best protection for probate avoidance. All other necessary Power of Attorney and up to date Health documents are included.

*  Generally, it is understood that no Living Trust avoids probate unless it is properly funded after it is created.  Of course, this complimentary service is included in our package plans profiled inside.

** Of course, portfolio owners need to keep their assets in trust as time passes to assure probate exclusion.  Special sections are available in the portfolio for recording all updates and changes in estate or trust assets.

Applicable documents are selected by the client based on criteria and legal advice is not provided in this service.  If legal advice is necessary, a referral will be made to a qualified estate planning attorney when possible.

The full version of this portfolio is an exact copy of our  Living Trust Portfolio for unmarried or married and separate asset clients, or for married clients, except instead of a Living Trust, a fancy Last Will & Testament document is prepared instead. In some cases, testamentary trust provisions are added to utilize Unified Credit exemption equivalents. Probate* may be required, especially upon the second death when married, and for singles with larger estates.

*  Generally, Arizona statutes do not currently require probate proceedings on small estates not exceeding $50,000 in Gross assets nor is probate required in many cases for married couples who have designated "Joint Tenancy" or "Community" property with rights of survivorship. In most cases where a small estate is required to enter into probate by statute, simplified or self-administration proceedings are usually allowed in cases where this power was granted by "affidavit" in the deceased persons' Last Will &Testament.

Applicable documents are selected by the client based on criteria and legal advice is not provided in this service.  If legal advice is necessary, a referral will be made to a qualified estate planning attorney when possible.
